Conditions of Use

SNOWORSAND TERMS AND CONDITIONS

By booking and paying for a trip with SnoworSand LLC, you agree to and accept the following terms and conditions. This agreement is between you, the participating customer (henceforth referred to as “you”) and SnoworSand LLC, 1970 E Grand Avenue Suite 110 El Segundo, CA USA (henceforth referred to as “SnoworSand”).

1. BOOKING AND PAYMENTS

1.1 To make a booking and guarantee your participation on any SnoworSand trip, you must agree to the terms and conditions listed below, and provide payment in full. SnoworSand accepts a booking on the understanding that full payment has been collected and held either by SnoworSand directly, or by one of our authorized sales agents or partners.

1.2 Upon confirmation of your booking and receipt of full payment, subject to availability and at the discretion of SnoworSand, SnoworSand will reserve your seat on the selected trip. It is the responsibility of you, the customer, to check the accuracy of the booking and the dates of travel.

1.3 Upon confirmation of your booking, SnoworSand will issue you a confirmation number and/or e-ticket. This confirmation number is required for participation in the selected trip.

2. TRIP DESCRIPTION

2.1 Unless otherwise stated in the trip itinerary, SnoworSand provides a travel expert to accompany you and supply knowledge of the destination city as well as showcase a number of activities over a period of time specified by the itinerary. This travel expert will provide walking trips of the destination city and recommendations regarding where to visit and see. The itinerary and activities provided are subject to change, and no substitutions will be made for missed or canceled activities or trips due to events including but not limited to acts of God, detention, annoyance, delays and expenses arising from quarantine, strikes, thefts, pilferage, failure of any means of conveyance to arrive or depart as scheduled, civil disturbances, government restrictions or regulations, discrepancies or changes in transit over which it has no control including strikes. Reasonable changes in itinerary may be made where deemed advisable for the comfort and well-being of the participants.

2.2 Depending on the type of trip and itinerary, other products and services including meals, transportation, activities and accommodations will be provided. In the case of intracity tranportation, SnoworSand provides public passes for subways, metros or light rails. In the case of intercity transportation, SnoworSand will provide coach, train, ferry or air transportation. In the case of ferry transportation deck or second class seats will be provided. In the case of train transportation second class seats will be provided. In the case of air transportation, economy or general seating will be provided. If accommodations are provided, they will vary from hostel to hotel to guest house and can include but are not limited to 2,4,6,8, & 10+ person rooms. Room preference is subject to availability and is on a first come first serve basis upon arrival at the hostel or guest house or hotel by the SnoworSand group.

3. CONTRACTING PARTIES

3.1 The booking conditions detailed herein contain the entire contract between you and SnoworSand. No representation, term, warranty or condition can be expressed or implied by reference to any other writing, advertisement or conversation.

3.2 Your contract is with SnoworSand LLC. SnoworSand reserves the right to nominate to you in writing any other company or person to have the benefit of some or all of the provisions of this contract, which SnoworSand may then specify, as if you had agreed to the provisions concerned directly with that company or person.

3.3 SnoworSand acts as a booking agent and contracts directly with coaches, boats, hostels, hotels and other service providers. All bookings with carriers and other service providers are subject to their terms and conditions and limitations of liability. It is important to note that some of these limit or exclude liability in respect of death, personal injury, delay and loss or damage to baggage. SnoworSand cannot accept any responsibility for any loss as a result of such actions or as a result of any act of error or omission of any such third parties.

3.4 Many accommodation arrangements provided by SnoworSand are contracted to third party providers. They are subject to the terms and conditions, and limitations of liability, imposed by the provider. All arrangements are made independently of SnoworSand, regardless of the booking of such arrangements by SnoworSand.

4. GUEST RESPONSIBILITIES

4.1 It is your responsibility to make sure you have a valid passport, and all necessary visas, permits or certificates on your person for your selected trip. SnoworSand is not liable for any problems, delays or denied entry in the event you are not in possession of valid travel documents.

4.2 You agree to comply with the authority of the SnoworSand travel advisor, and the laws and regulations of the counties visited, including customs and foreign exchange restrictions. If you do not comply with said reservations, you will be asked by the SnoworSand travel advisor to leave the trip. You are not eligible for refunds under such circumstances.

4.3 There may be times when the SnoworSand travel expert must make a decision for the safety and/or the best interests of the group. It is a condition of booking that you comply with the authority and decisions of the SnoworSand travel expert. If you do not comply, or if in the opinion of the SnoworSand travel expert, you are not compatible with the general enjoyment of the group or the smooth operation of the trip, SnoworSand reserves the right to refuse to allow you to continue with the trip. You agree that SnoworSand has the exclusive right to dispel you from a trip at anytime, without any claims or complaints by you against SnoworSand. In such a case SnoworSand will not be liable for any refund, compensation, or additional costs incurred by you.

4.4 It is your responsibility to meet the transportation or travel expert provided by SnoworSand at the correct time and location for departure. In the event you miss a planned departure, any extra travel costs incurred are paid by you. It is your responsibility to check in with the SnoworSand travel expert 15 minutes prior to the specified departure time. Due to the nature of the services provided, SnoworSand will not be liable if any service departs or arrives later than the specified time, even if as a result you miss a connecting service.

4.5 SnoworSand may not be held responsible for your personal belongings. It is your responsibility to look after your belongings. SnoworSand cannot be held responsible for loss, theft or damage to any of your personal belongings, regardless of the circumstances.

4.6 The products offered by SnoworSand are travel packages consisting travel expert guide services and other accommodations, meals and activities as specified by the itinerary. SnoworSand travel advisors cannot offer constant special attention or assistance should you have any physical disability requiring such attention.

4.7 You agree that SnoworSand may take photographs and films of you while you are participating on a SnoworSand trip. You agree that these images may be used for marketing purposes by SnoworSand. These images may be used in, but are not limited to, brochures, websites, print media and promotional videos. These images may be used for publicity and advertising without SnoworSand obtaining further consent or payment for the use of the images.

5. LOCAL TRIPS AND EXCURSIONS

5.1 You will have the opportunity to purchase from SnoworSand local trips and/or excursions at your chosen destination. Trips and excursions are not included in the price of your trip (unless otherwise stated). You are responsible for any additional costs.

5.2 Any trips and excursions purchased by you are run by local operators and you will be subject to their terms and conditions.

5.3 Local trips and excursions purchased through SnoworSand are non-refundable and non-transferable. It is your responsibility to meet the trip at the designated departure point and time.

5.4 It is your responsibility to keep track of any local trip and excursion vouchers or tickets issued to you by SnoworSand. Lost vouchers or tickets cannot be replaced.

6. INSURANCE

6.1 There is no travel insurance included in the cost of any SnoworSand trip or package, ticket, or product.

6.2 SnoworSand highly recommends that you purchase your own travel insurance that covers all of your travels. SnoworSand strongly recommends that you are covered by a comprehensive insurance policy which includes: personal accident, medical expenses, personal baggage, money and public liability.

7. WEATHER, ENVIRONMENTAL AND POLITICAL CONDITIONS

7.1 SnoworSand may not be held responsible for any delay, deviation, or cancellation due to weather conditions. No trip may be canceled or changed by you at anytime on the basis of weather conditions.

7.2 SnoworSand may not be held responsible for delay, deviation, or cancellation due to labor disputes (including strikes that are previously announced or spontaneous), border problems or other political or economic factors.

7.3 SnoworSand may not be held responsible for delay, deviation, or cancellation due to mechanical failure, or other issues that may arise and are outside of our control.

8. CANCELLATIONS/CHANGES

8.1 Any discounted fares, promotion fares, and package deals are non-refundable.

8.2 Promotional trips as prizes are non-transferable.

8.3 Cancellation/change of a booking by you must be made in writing to SnoworSand prior to the day of departure and may incur an additional charge. The following cancellation policies apply:

a. After booking, you may receive a 50% refund up to 7 days prior to departure.

b. Less than 7 days prior to departure no refund. Any booking or payment made with less than 7 days remaining before the trip are subject to the same regulations.

8.5 No refunds will be made in respect of any unused portion of a ticket or partially completed trip.

8.6 Although unlikely, trips may be canceled/changed by SnoworSand due to lack of the minimum number of participants or other unforeseen circumstances. SnoworSand reserves the right to cancel/change trips up to but not less than 12 hours in advance with exception for the conditions contained in Section 7, "Weather, Environmental and Political Conditions". In the event a trip is canceled/changed, you will be notified via email or phone. In the event of a cancellation by SnoworSand you will receive a full refund for the amount paid.

9. GENERAL WAIVER OF LIABILITY

I agree and understand that I hold SnoworSand, its officers, partners, employees and agents harmless from all liability and claims arising out of or in connection with my participation in this purchased trip including but not limited to the dangers involved with traveling and adventure activities. I hereby release and discharge SnoworSand and its officers, partners, employees and agents from all liability arising out of or in connection with the purchased trip. I understand that my participation in the purchased trip is voluntary and is not required and is at will.

WEBSITE POLICIES

INFORMATION THIS SITE GATHERS/TRACKS

We use your IP address and browser type to help diagnose problems with our server and to administer our Web site. This means that a user's session will be tracked, but the user will remain anonymous. Your IP address is used to help identify you and your shopping cart and to gather broad demographic information. This means that although your IP address may be associated during your session, it is not permanently associated with any of your personal information.

INFORMATION SHARING AND DISCLOSURE

Personally Identifiable Information (PII):

We share PII with Third Parties to perform functions on our behalf. Examples include fulfilling orders, processing credit card payments, delivering packages, sending email and postal mail, and analyzing data for the purposes of data scrubbing and marketing assistance. We do not share PII with Third Parties for any unknown or unrelated uses.

We reserve the right to disclose PII as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process served on our Web site.

If we decide to change our privacy policy, we will post those changes to this privacy statement, the homepage, and other places we deem appropriate so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. We reserve the right to modify this privacy statement at any time, so please review it frequently. If we make material changes to this policy, we will notify you here, by email, or by means of a notice on our homepage.

AGENTS

This Web site uses an order form for customers to request information, products, and services. We employ other companies and individuals (Agents) to perform functions on our behalf.

We use Agents to fulfill and distribute orders, to bill you for goods and services, and to assist us in marketing efforts. They have access to PII needed to perform their functions but are prohibited from retaining, sharing, storing, or using PII for any other purposes.

Aggregate Information (non-personally identifiable)

We use Third Party Service Providers to assist us in analyzing the aggregate information about the visitors on our site. This information, which helps us optimize the usability of our site, is collected via Service Provider cookie or log files. We do not link any aggregate information to PII.

COOKIES

We use cookies to keep track of your shopping cart, customize your future shopping, and to assist your needs. Upon your request, we can use cookies to deliver content specific to your interests and to save your password so that you do not have to re-enter it each time you visit our site.

This site contains links to other sites. SnoworSand is not responsible for the privacy practices or the content of such Web sites. We encourage you to read posted privacy statements whenever interacting with any Web site. We will not share any specific information that you provide to us without your explicit permission to share it. We may share broad demographic information with others. We will never release your personal information (including but not limited to your name, email address, street address, and phone number) without your express permission. Users have the ability to change their preferences with us at any time; see our opt out policy below.

ORDER FORM

BULLETIN BOARDS/CHAT ROOMS

SnoworSand is not responsible for any PII you choose to submit in these forums. Any PII you submit there could be read, collected, or used by other users of these forums, and could be used to send you unsolicited messages.

SECURITY

The security of your personal information is important to us. When you enter sensitive information (such as credit card number) on our registration or order forms, we encrypt that information using secure socket layer technology (SSL). We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

THIRD PARTY NOTIFICATION

If your personal information is ever collected by any Third Party that is not our agent/service provider, you will be notified so you can make an informed choice as to whether or not to share your information with that party.

REGISTRATION

You can browse our site without entering any personal information and, therefore, remain anonymous during your visit. However, we hope that all of our visitors will register with us so that we can learn more about our valuable customers. Our site's optional registration form requires users to give us contact information (such as their name and email address). We use customer contact information from the registration form to send the user relevant newsletters and special offers. This information is also used to contact the customer if necessary. If you would rather not receive newsletters and/or special offers, please indicate your preference by marking the appropriate boxes in the Membership Account Maintenance section of our site. Users may opt-out of receiving any communications from our company at any time. Please review our opt out policy below.

OPT-OUT POLICY

If you no longer wish to receive our newsletters and promotional communications, you may opt-out of receiving them by following the instructions included in each newsletter or communication or by emailing us at admin@snoworsand.com with "Unsubscribe" in the subject line. We also offer an opportunity to opt-out of certain communications in our member information area or you may contact us at the contact information listed at the bottom of this policy. You are not able to opt-out of emails related to a specific order (confirmation emails).

ACCESS TO PERSONALLY IDENTIFIABLE INFORMATION
